Clients frequently have questions regarding what is considered income in their Florida divorce or family law matter.  When filing for any family law matter in Central Florida such as a Dissolution of Marriage, Paternity, or Modification, you will be required to complete a Family Law Financial Affidavit.  This is a mandatory part of the discovery process which allows each party to have knowledge of the financial position of the other party.

On the Family Law Financial Affidavit, you will be required to state your monthly income.  For some clients, this is a simple question.  However, for many, it is not as clear.  If you are receiving tips, bonuses, or overtime, these must be stated on the Affidavit.  All unemployment and worker’s compensation benefits or settlements must also be included.  Other examples of income that should be included in gross income include pension, retirement or annuity payments as well as alimony. Rental income and interest and dividends must also be included on your Financial Affidavit.
