You’ve just been notified your deposition will be taken in your Florida family law case.  You understand the importance of your answers and are anxious about the process.  There are several things you can do to help ensure a successful deposition.

Perhaps the most important thing to remember is to listen to the entire question before answering.  This is particularly important if the question is long.  People tend to begin to formulate an answer before the entire question is stated.  When that happens, often we do not hear the end, and possibly the most important part, of the question.  Resist the urge to consider your answer while the question is being asked. 

Take time to understand and think about the question.  You are not required to answer any question you do not understand.  There is also no need to rush to answer a question quickly.  If you are uncertain at all about the meaning of the question being asked, ask for clarification.  Then take the time to give the most accurate and honest answer you can.  Your answers will be recorded by a court reporter and used as evidence during your trial.  Therefore, it could be more harmful to your case if you answer a question without completely understanding it.

Listen closely to any objections that your attorney makes.  Carefully considering the objections may help you avoid damaging testimony.  Talk with your attorney before the deposition about the types of objections that are typically made and how they can help you answer more effectively. 

Be sure to answer only the question.  Sometimes only a yes or no is required.  Do not volunteer more information.  Many people tend to think that if a questioning attorney does not begin another question immediately after their answer, they must have to add more to the answer.  Answer truthfully and accurately then wait quietly for the next question.
