Once the difficult decision is made to file for a divorce or dissolution of marriage, many people want to know how quickly they can obtain the final judgment.  The answer to that question depends on several factors.

The main factor in determining the length of a divorce is whether or not you and your spouse are able to agree on all the issues specific to your situation.  These issues may include child support, custody, time sharing, alimony, and division of property and debts.  When a couple can agree on how to resolve all of these issues, the divorce is considered uncontested.  In an uncontested divorce, a Marital Settlement Agreement can be signed by both parties and filed with the Court for incorporation into the final divorce order.

When the couple is facing a contested divorce they are unable to agree on one or more of the issues.  The Court must decide on how to resolve the issues the couple has not been able to agree upon.  The time to complete a divorce under these circumstances will vary depending on the complexity of the unresolved issues.  It is not uncommon for this process to take 6 months or longer.  If the Court in your county is very busy, it can take a year or longer.
